RESOLUTION VACATING A PORTION OF DOGWOOD ROAD AS DEDICATED IN
THE PLAT OF SUNSET HILL ON LAKE MINNEWASHTA
WHEREAS, The City of Chanhassen (“City”) proposes to vacate of a portion of Dogwood
Road legally described in Exhibit A and depicted in Exhibit B attached hereto and incorporated herein
(collectively referred to herein as the “Vacation Area”); and
WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of
Chanhassen has conducted a hearing preceded by the statutorily required two (2) weeks published
and posted notice and mailed notice to the abutting property owners, to consider the vacation ; and
WHEREAS, the vacation of the Vacation Area is necessary to dispose of excess public right
of way that serves no existing or future public use; and
WHEREAS, the Vacated Area will revert to the adjacent properties as depicted in Exhibit B;
and
WHEREAS, a public drainage and utility easement is hereby reserved over the entirety of the
Vacated Area; and
WHEREAS, the vacation is conditioned on recording of an ingress and egress easement over
Lot 3, Block 1, GETSCH ADDITION in favor of Lot 4, Block 1, GETSCH ADDITION for the
existing driveway within said Lot 3 and the Vacation Area, which shall be recorded simultaneously
with this vacation.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chanhassen City Council:
1. The vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer
lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue
maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace,
remove, or otherwise attend thereof; and
2. The City Clerk shall transmit a certified copy of this Resolution to the County Auditor
and County Recorder.
