THIS AMENDMENT TO STOR]T'IWATER MAINTENANCE
AGREEMENT/BEST MANAGEMENT PRACTICE FACILITIES ("Amendment") is made
this L\ day of Oc{abey' ,2025, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation ("City") and MICHAEL ROHLFSEN and MIMI CHO-
ROHLFSEN, spouses married to each other (the "Owners").
KEC ITALS
A. The City and Fox Hill Properties, LLC, a Minnesota limited liability company,
predecessor in interest to the Owners, entered into a Stormwater Maintenance AgreemenVBest
lltanagement Practice Facilities dated March 13. 2025 and recorded with the Carver County
xegisrar of Title's Office on June 6, 2023 as Document No. T227284 ("Agreement") for the
property legally described in Exhibit A attached hereto ("Property");
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for
other good and valuable consideration, the City and Owners agree as follows:
I. Exhibit B, Exlibit B to the Agreement is amended in its entirety as provided rn
Exhibit B, attached hereto.
2. Survival ofother Provisions ofAgreement Except as otherwise provided in this
Amendment, all other provisions ofthe Agreement survive and shall be given full force and effect.

B. The stormwater Facilities within the Property have been modified and the parties
.jcsire to correcr exhibits to the Agreement.
3. Recording. This Amendment will be recorded against the Property and will run
with the land and bind Owners' successors and assigns.
