BEST MANAGEMENT PRACTICE FACILITIES
THIS AMENDMENT TO STORMWATER MAINTENANCE
AGREEMENT/BEST MANAGEMENT PRACTICE FACILITIES ("Amendment") is made
this 2-t Oay of OC\dlzr t/ ,2025, by and between the CITy OF CHAI\IHASSEN, a
Minnesota municipal corporation ("City") and AHA RE LLC, a Delaware limited liability
company (the "Ownei').
RECITALS
A. The City and Fox Hill Properties, LLC, a Minnesota limited liabitity company,
predecessor in interest to the owner, entered into a Stormwater Maintenance Agreement/Best
Management Practice Facilities dated March 13,2025 and recorded with the Carver County
Registrar of Title's Office on June 6, 2023 as Document No. T227285 (..Agreement') for the
property legally described in Exhibit A attached hereto ("Property");
B. The stormwater Facilities within the Property have been modified and the parties
desire to correct exhibits to the Agreement.
NOW' TIIEREFORE, in consideration of the mutual covenants contained herein and for
other good and valuable consideration, the City and Owner agree as follows:
l. Exhibit B. Exhibit B to the Agreement is amended in its entirety as provided in
Exhibit B, attached hereto.
2. Survival ofOther Provisions ofAgreement Except as otherwise provided in this
Amendment, all other provisions ofthe Agreement survive and shall be given full force and effect.

3. Recording. This Amendment will be recorded against the Property and will run
with the land and bind Owner's successors and assigns.
