l. Permit. Subject to the terms and conditions set forth herein, the City ofChanhassen hereby
grants the following variance:
The Chanhassen Board of Appeals and Adjustments approves the requested decreased
side yard setbacks. subject to the conditions ofapproval and adopts the attached Findings
of Facts and Decision.
2. Propertv. The variance is for a property situated in the Ciq ofChanhassen, Carver County,
Minnesota. and legally described in Exhibit A.
3. Conditions. l'he variance approval is subject to the fbllowing conditions:

1. Building plans must provide sufficient infbrmalion to verifr that proposed building
meets all requirements of the Minnesota Stale Building Code. additional comments or
requirements may be required atier plan review
2. Structure proximity to property lines (and other buildings) will have an impact on the code
requirements for the proposed buildings. including but not limited tol allowable size,
protected openings and fire-resistive construction.-l-hese requirements will be addressed
when complete building and site plans are submitted.
3. Retaining walls (ifpresent) more than four feet high, measured from the bottom ofthe
footing to the top ofthe wall, must be designed by a professional engineer and a building
permil must be obtained prior to construction. Retaining rvalls (ifpresent) under lour feet in
height require a zoning permit.
4. A building permit must be obtained prior to demolishing any structures on the sile and before
beginning any construction on the site.
5. Ifany soil conections are done on the propefty a final grading plan and soil repotl Inust be
submitted to the Inspections Division before pennits will be issued.

6. The location and configuration ofthe garage and driveway must substantially conform lo
what is shown on the proposed survey by Sisu Land Surveying submitted on August 19.
