24-10 Chaparral PUD AmendmentPlanning Case #2024-10 Chaparral Planned Unit Development Planning Commission – July 16, 2024 Tentative City Council – August 12, 2024 Applicant: Chaparral HOA Requesting a minor amendment to the Chaparral PUD deck regulations for Duplexes and Single-Family homes. 1 Location: Chaparral PUD Zoning: Planned Unit Development Residential Land Use: Low Density Residential & Medium Density Residential 1st Addition: Single-Family 2nd Addition: Duplexes & Quad-Units 3rd Addition: Duplexes & Quad-Units 2 Proposed Minor PUD Amendment Current PUDR regulations state decks must be 10 feet by 20 feet. Staff recommends removing all deck dimensional requirements for the Duplexes and Single-Family. All Quadplex regulations shall remain. Quadplexes have additional and complex regulations beyond those that apply to duplexes and single-family. 3 Application and Final Proposal Original proposal by Chaparral HOA proposed a deck dimension maximum for duplexes of 10 feet by 12 feet. The requirements in place according to the Applicant creates a financial burden for the Chaparral HOA given the cost of labor and materials. Staff recommends and proposes removing the deck dimensional requirements. Staff research did not find any other PUDRs that specifically regulate deck dimension. All decks outside of Chaparral in the City of Chanhassen are implicitly regulated through building setbacks. 4 How does this affect current decks? By removing the deck dimensional requirements, the only requirements future new decks will need to meet is the building setbacks applicable to the parcel. These setbacks already apply to existing decks. HOAs can add any dimensional requirements within the bylaws of the HOA.
