FINDINGS OF FACT
AND DECISION
IN RE:
Extension Request for a Conditional Use Permit (CUP) by Beniek Property Services.
On September 2, 2025, the Planning Commission heard staff’s presentation of the extension
request and recommended approval of the CUP 24-09 extension request.
FINDINGS OF FACT
1. On September 23, 2024, the Chanhassen City Council approved the requested Conditional
Use Permit (CUP 24-09) for a contractor’s yard at the property legally described as Lot 10 &
11, Block 5, Chanhassen Lakes Business Park.
2. A request for extension of the CUP was made by the property owner due to the following
condition of the CUP approval, “Lapse. If within one year of the issuance of this permit the
authorized construction has not been substantially completed or the use commenced, this
permit shall lapse, unless an extension is granted in accordance with the Chanhassen Zoning
Ordinance”.
3. An extension shall be granted for one additional year for the Conditional Use Permit to reach
completion of substantial construction, therefore fulfilling the conditions of the CUP 24-09.
DECISION
The City Council approves the proposed extension to the conditional use permit based on
the findings of fact included herein, and subject to the conditions of the original CUP 24-09.
