2025-58.docx175251908v1 EXTRACT OF MINUTES OF A MEETING OF THE CITY COUNCIL OF THE CITY OF CHANHASSEN, MINNESOTA HELD: AUGUST 25, 2025 Pursuant to due call and notice thereof, a regular or special meeting of the City Council of the City of Chanhassen, Carver and Hennepin Counties, Minnesota, was duly held at City Hall on August 25, 2025 at 7:00 P.M., for the purpose, in part, of approving property tax abatements. The following members were present: Ryan, McDonald, Schubert, von Oven and the following were absent: Kimber Member Schubert introduced the following resolution and moved its adoption: RESOLUTION NO. 2025-58 RESOLUTION APPROVING PROPERTY TAX ABATEMENTS WHEREAS, the City Council (the "Council") of the City of Chanhassen, Minnesota (the "City"), proposes to approve tax abatements to finance the costs related to sitework, park and community amenity improvement portions of the Civic Campus Project, not including the City Hall, within the City (the "Project"). The City proposes to use the abatement for the purposes provided for in the Abatement Law (as hereinafter defined), including the Project. The proposed term of the abatement will not exceed 20 years in an amount not to exceed $13,000,000. The County has declined, in writing, to grant an abatement and therefore the City has the authority to grant an abatement for up to twenty (20) years; and WHEREAS, on the date hereof, the Council held a public hearing on the question of the Abatement (as hereinafter defined), and notice of said hearing was published in a newspaper of general circulation in the City at least once more than ten days but less than 30 days before the hearing; and Docusign Envelope ID: 17EEEBDB-71EE-4920-8646-60109DB703F7 175251908v1 2 WHEREAS, the Council proposes to issue its general obligation abatement bonds in an amount not to exceed $8,000,000, in one or more series, to finance the Project; and the Abatement will be pledged to payment of the Bonds; and WHEREAS, the Abatement is authorized under Minnesota Statutes, Sections 469.1812 through 469.1815, as amended (the "Abatement Law"). 1. Findings for the Abatement. The City Council of the City of Chanhassen, Minnesota hereby makes the following findings: (a) The Council expects the benefits to the City of the Abatement to at least equal or exceed the costs to the City thereof. (b) Granting the Abatement is in the public interest because it will help provide access to services for residents of the political subdivision. (c) The Tax Abatement Property is not and will not be located in a tax increment financing district during the Abatement period. (d) In any year, the total amount of property taxes abated by the City by this and other existing abatement resolutions, shall not exceed ten percent (10%) of net tax capacity of the City for the taxes payable year to which the abatement applies or $200,000, whichever is greater (the "Abatement Limit"). The City may grant other abatements permitted under the Abatement Law after the date of this resolution, provided that to the extent the total abatements in any year exceed the Abatement Limit the allocation of the Abatement limit to such other abatements is subordinate to the Abatement granted by this resolution. 2. Terms of Abatement. The Abatement is hereby approved. The terms of the Abatement are as follows: (a) The Abatement shall be for up to 20 years anticipated to commence for the taxes levied in 2025 and payable in the year 2026. The City reserves the right to modify the commencement date, but the abatement period shall not exceed 20 years. (b) In accordance with Section 469.1815 of the Act, the City will add to its levy in each year during the term of the Abatement the total estimated amount of current year Abatement granted under this resolution. (c) The City will abate the City's share of property tax amount which the City receives from the Tax Abatement Property, cumulatively not to exceed $13,000,000. (d) The Abatement shall be subject to all the terms and limitations of the Abatement Law.
