was obtained. Tenant ha.s sitrce used the Garden Cemer for rerail sale of goods to the
general public.
WHEREAS, in May 1994, dte Cily inryectsd the Gardcn Center. The City Buildirg
Official found that thc Gardefl Ccntcr did not comply with the Uniform Building Code
('LIBC') requirements for a B-2 occupatrcy.
WHEREAS, on fune 1, 1994, the City initiated a civil lawzuit agaiost Tcmnt seeking
to permanently enjoin Tenant's operation of a retail commerrial business ftpnr thc Gardcn
Ccnter unless a Building Permit was obtaif,ed, the necessary requiremcnts for a B-2
occupancy were satisfied and a certificate of occupancy issued.
WIIDREAS, Tenant has obtained r Builrling Permit and has complied with the March
20, 1995 lrtter of Understanding and completed nll requiremetrts for a B-2 occupancy for
the Garden Center, with a fue alarm monitorilg system in lieu of a sprinkler system. The
Cily must still conduct a final inspection and issue a Certificate of Occupancy, if appropriate.
WHEREAS, oil luly 15, 1994, Terrant filed arr fuiswer and Cr.rurrerclaim tr: the
City's Complaint.
WIIEREAS, the Tenant and Ciry want to provide for the long term land use of the
Subject Propcrty.
WIIEREAS, the City is desirous of exercising its zoning and police powers fbr tlrc

A. Nursery Stock and Nursery Equipment - Defrned. Nursery stock neans
