This allows local Sovernment units to look ahead several years at programmatic and facility needs necessary to meet state and federalrequirements as well as to address more acute issues such as drainage and flooding. As of 2007, the Metropolitan Council determined that 83 communities within the seven county metropolitan area have a stormwater utility. Overl/3of these came to exist in the early 1990's after the Minnesota Board of Soil and Water Resources adopted rules that required the creation of local surface water management plans. ln, or around 2004 there was another spike in the total number of communities that formed a stormwater utility. This later spike was in response to the National Pollution Discharge Elimination System MS4 permit. By having a utility fund for stormwater, we are able to have a stable, adequate and equitable fund directed solely to the maintenance, expansion and improvement of the storm sewer system, Numerous basic rate methodologies have been employed by various municipalities and other local unit of government. Some of these basic methods for predicting demand on the system include impervious area calculations, the ratio of impervious area to gross area, gross area with some factor or constant related to development intensity, or runoff coefficient. Regardless of the methodology used, the intent is still the same, to make the fee proportionate to the impact on the system. The greater the impervious surface, the greater the impact or use of the system. When Chanhassen adopted their utility fee, it was decided to equate it to land use and gross area. The question has been raised by the current property owner as to whether the property should be classified as an agricultural or commercialland use. on a site. The exception was with agricultural land and single family residential land where a base charge is a pplied. LAND USE DESIG NATION 1997 Judqment ln the stipulation for entry ofjudgment dated February 10, 1997 in the case brought by Chanhassen against Halla Nursery, lnc. the court was very clear that the operations at 10000 Great Plains Boulevard constitute retail sales. To wit: "WHERAS, in early 1994, Tenant constructed a new retail sales building ("Garden Center")of a pproximately 5,000 square feet...." "WHEREAS, on June 1, 1994, the City initiated a civil lawsuit against the Tenant seeking to permanently enjoin Tenant's operation of a retail commercial business from the Garden Center...." The judgment continues on to define what retail activities will be allowed and which retail activities will be prohibited on the site. The.judgment also defines the landscape yard as "an area where vehicles, equipment and materials commonly used by nurseries and landscaping contractors are stored or serviced,"1 From these statements, it is clear that the courts concluded that the activities at 10000 Great Plains Boulevard constituted a commercial use. ln addition, Mustard Seed is a landscapin8 company which is a commercial business. Comporotive Business ln a letter dated Ma rch 11, 2013 a nd a subsequent letter dated J une 71,20L3, M r. Halla contends that the storm water utility fee is "capricious and unequal when compared to other'like'uses". ldo not agree with this contention. Mr. Halla operates a garden center and a landscaping company. This use is most "like" the use at 78 West 78th Street (By The Woods) and 850 Flying Cloud Drive (Bluff Creek Gardens). ln both cases a retail garden center is operated from the property and in both cases a landscape yard is maintained and operated on site. Neitherofthese properties are classified as agricultural. However, Bluff Creek Gardens was placed in class 5 (industrial) while By The Woods was placed in class 6 (commercial) as is Mustard Seed at Halla Nursery. Mr. Halla contends that his business is more akin to Holasek or Wilson Nursery. Neither of these locations maintains a landscape yard or a garden center. ln the case of Holasek, over half of the property is currently being cultivated - a clear agricultural practice. ln addition to not maintaining a garden center or landscape yard, Wilson Nursery includes a single family residential home and has left 30 of the 39 acres in an unimproved natural state and has only 1 acre covered in impervious surface.2 Wilson Nursery and Holasek both produce their own nursery stock while Halla, to the best of my knowledge, purchases nursery stock from elsewhere and sells to the public. This means that even their nursery is a reta il/commercia I business. But even if they do produce their own stock, they are primarily a commercial land use as evidenced by the judgment, the garden center and the landscape yard. CONCLUSION Based upon the following facts and observations, the assessed fee is not arbitrary, capricious or unfair The First Judicial District Court clearly defines the business at 10000 Great Plains Boulevard as commercial in nature, A review of comparable businesses indicates that 'like' businesses are charged 'like' stormwater utility fees. A review of aerial photography clearly shows that the intensity of development on the site is much more comparable to that of 78 West 78rh Street and 850 Flying Cloud Drive rather than 9150 Great Plains Boulevard or 8610 Galpin Boulevard. It may be that category 6 Business/Com mercial is too far reaching in its inclusion. However, there is no other category to which garden centers and landscaping contractors would obviously belong. Any changes could result in a cascade effect as lawn care and grounds keeping companies are considered. The property at 10000 Great Plains Boulevard is being assessed appropriately and the property at 850 Flying Cloud Road should be adjusted. This process was already under way as they recently made a lot line adjustment. cc.
