GRANT OF PER]VIANENT EASEMENT
FOR PUBLIC DRAINAGE AI{D UTILITY PURPOSES
MICTIAEL J. WEIS snd sHERRy IC WEIS, spouses rruuried to each other
("Grantors"), in consideration of One Dollar ($1.00) and other good and valuable consideration,
the receip and su(ficiency of which is hereby acknowledged, do hereby grant unto the cITy oF,
CHANIIASSEN, a Minnesota municipal corporation, the Grantee, hereinafter referred to as the
"City"' its successors and assigns, forever, a permanent easement for public drainage and utility
purposes over, orl across' under and through the land situated in the County of Carver, State of
Minnesota' as legally described on the attached Exhibit 'A" and depicted on the attached Exhibit
"B" (the "Easement Property,').
INCLIJDING the rights of the city, its contractorc, agents, servants, and assigns, ro enter
upon the Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systerns over, across, on, under, and through the Easement
Property, together with the right to grade, lever, fill, drain, pave, and excavate the Easement
Property, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, constructioo, and maintenance of said public drainage and ut ity
systems
The above-named Grantors, for themserves, their heirs, successors and assigns, does
covenant with the City, its successors and assigns, that they are well seized in fee title of the
Easement Property; that they have the sore right to grant and convey the easement to the city; that
there are no unrecorded interests in the Easement property; and they will indemnifi and hold the
City harmless for any breach ofthe foregoing covenants.

An easement for drainage and utility purposes over, under, across and through that part of the
southeasterly 5.00 feet ofthe following described parcel:
Lot 1, Block I, ROOK PLACE, according to the recorded plat thereof, Carver County, Minnesota,
and also all that part oflot 2, said Block 1, which lies northwesterly ofthe following described tine:
Commencing at the Northwest comer of said Lot I ; thance South 58 degrees 20 minutes 49 seconds
East, assumed bearing along the northeasterly line ofsaid Lot l, a distance of 127.00 feet to the point
ofbeginning of said line to be hereinafter described; thence South 32 degrees 10 minutes 07 seconds
West 99.95 feet; thence South 13 degreas 22 minutes 56 seconds West 149. 54 feet to the
southerly line of said Lot 2 and said line there terminating.
