GRANT OF PER]VIANENT EASEMENT
FOR PUBLIC DRAINAGE AND UTILITY PURPOSES
MICHAEL E. LYNCH, widowed and not remarried ("Grantor"), in consideration of One
Dollar ($1.00) and other good and valuable consideration, the receipt and suffrciency of which is
hereby acknowledged, does hereby grant unto the CITY OF CHANHASSEN, a Minnesota
municipal corporatiorl the Grantee, hereinafter referred to as the "City", its successors and assigns,
forever, a permanent easement for public drainage and utility purposes over, on, across, under and
through the land situated in the County of Carver, State of Minnesot4 as legally described on the
attached Exhibit "A" and depicted on the attached Exhibit "8" (the "Easement Property").
INCLLJDING the rights of the City, its contactors, agents, sewants, and assigns, to enter
upon the Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the Easement
Property, together with the right to grade, level, fill, drain, pave, and excavate the Easement
Property, and the further right to remove trees, bushes, undergrowth, and other obstructions
interfering with the location, construction, and maintenance of said public drainage and utility
systems.

The above-named Grantor, for himself, his heirs, successors and assigns, does covenant
with the City, its successors and assigns, that he is well seized in fee title ofthe Easement Property;
that he has the sole right to grant and convey the easement to the City; that there are no unrecorded
interests in the Easement Property; and he will indemni& and hold the City harmless for any breach
of the foregoing covenants.

northwesterly 5.00 feet of the following described parcel:
All the part oflot 2, Block l, ROOK PLACE, according to the recorded plat thereof, Carver County,
Mirmesota, which lies southeastetly of the following described line:
Commencing at the Northwest comer of Lot 1, said Block l; thence South 58 degrees 20 minutes 49
seconds East, assumed bearing along the northeasterly line of said Lot l, a distance of 127. 00 feet
to the point of beginning of said line to be hereinafter described; thence South 32 degees l0 minutes
07 seconds West 99.95 feet; thence South l3 degrees 22 minutes 56 seconds West 149.54 feet to the
southerly line of said Lot 2 and said line there terminating.
