2025-55CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION NO. 2025-55 A RESOLUTION APPROVING CONVEYANCE OF CERTAIN REAL PROPERTY IN THE CITY OF CHANHASSEN AND DISPENSING WITH STATUTORY REQUIREMENTS FOR REVIEW BY PLANNING COMMISION WHEREAS, the City acquired the property legally described in Exhibit A by condemnation for Nez Perce Drive ("Property"), which Property is located within the proposed plat of Pleasant View Pointe ("Plat"); WHEREAS, the City previously adopted Resolution No. 2025-52 vacating the proposed right of way over the Property; WHEREAS, the right of way for Peaceful Lane to be dedicated with the Plat will replace the right of way for Nez Perce Drive; WHEREAS, a quit claim deed from the City to Rachel Development, Inc. ("Developer"), owner and developer of the property to be platted, is necessary to remove the City's fee interest in the Property, in exchange for the dedication of Peaceful Lane; WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review the City's proposed disposal of real property for compliance with the comprehensive plan and to report to the City Council in writing its findings; and WHEREAS, Minn. Stat. §462.356, subd. 2 provides for an exception from the requirement for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the requirement and finding that the disposal of the real property has no relationship to the comprehensive municipal plan; and NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota: 1.The City Council finds that the disposal of the Property to the Developer of the Plat has no relationship to the comprehensive municipal plan. 2.Review by the Planning Commission of the disposal of the Property is hereby dispensed with and conveyance of the City's interest in the Property by quit claim deed to the Developer is approved conditioned upon simultaneous recording of the quit claim deed 1 236829vl with the Plat. 3. The Mayor and City Manager are authorized and directed to execute all documents, and take all appropriate measures to dispose of the Property accordingly.
